% 01.10.2018 After some hearing, the counsel for the petitioner submitted, on instructions, that he may be allowed to withdraw the present petition, the petitioner reserving the right to further cross-examine the complainant (CW1) at the stage of post charge evidence, in the event of charge being framed, he at the same time, requesting that he may be granted extended time to pay the costs of Rs. 25,000/- which were imposed by order dated 12.10.2017, the warrant of attachment having been issued in such respect by order dated 27.08.2018, he undertaking to pay the costs within two months hereof. The petition and the applications filed therewith are dismissed as withdrawn. In view of the undertaking given, the request for enlargement of time to pay the costs within two months hereof is granted to the petitioner. The said period would run from today. In this view, the Metropolitan CRL.M.C. 5016/2018
Magistrate will presently recall the attachment warrant issued in terms of the order dated 27.08.2018. In case of default, all consequences in law including by attachment warrant will follow.
