This petition under Article 227 of the Constitution of India seeks a direction to the Court of Sh. M.C. Gupta, Family Court, North-West District, Rohini Courts, Delhi to decide the application filed by the petitioners viz. Mt. No.56194/2016 (Old Mt. No.169/2011) for interim maintenance in a time bound manner. It is argued that the proceedings for claiming maintenance from the son were filed by the petitioners way back in the year 2011 and inspite of having remained pending for the last six years, no order has been passed in the application for interim maintenance. 4.

I have perused the order sheet in the proceedings from which this petition arises and it does indeed appear that there has been undue delay in disposal of the application for interim maintenance. It is also found that the CM(M) 937/2017

respondent has been indulging in dilatory tactics, though some dates have been taken by the counsel for the petitioners also. 5.

The counsel for the petitioners assures that henceforth there will be no adjournment on his behalf and he will appear before the Trial Court whenever the matter is called out.

For issuing a direction for time bound disposal of the application for interim maintenance, need to issue notice to the respondent is not felt. 7.

On enquiry, it is informed that the proceedings before the Family Court are listed today and have not been taken up till now i.e. 1215 hours. 8.

The petition is disposed of by directing the Court of Sh. M.C. Gupta, Family Court, North-West District, Rohini Courts, Delhi to decide the application filed by the petitioners viz. Mt. No.56194/2016 (Old Mt. No.169/2011) for interim maintenance latest by end of September, 2017 and to decide the proceedings for maintenance also, expeditiously.
