It is not disputed by Mr. Rajesh Gogna, CGSC that the issue raised in the present petition is covered by the judgment of the Division Bench of this court dated 12.1.2018, passed in bunch of petitions, the lead petition being WP(C)No13/2016, titled: Union of India & Anr. vs. Satnam Singh 2.

The issue involved in this case, is that, whether the petitioner, who had sought political asylum, was entitled to issuance of passport by the Government of India.

In view of the decision of this court, rendered in the aforementioned matter, this writ petition would have to be allowed. 4.

It is ordered accordingly.

I may note that Mr. Rajesh Gogna, CGSC has indicated to me that respondents are in the process of examining the judgment and taking a decision as to whether or not a special leave petition is to be filed qua the aforementioned judgment.

Needless to say, if a special leave petition is filed, the order passed in the said petition will govern the fate of this case as well, unless it is

distinguishable on facts.
