% 31.01.2017 CM No.3859/2017 (exemption) Exemption allowed, subject to all just exceptions. RC.REV. 42/2017 & CM No.3858/2017 I have heard learned counsel for the petitioner. After making submissions learned counsel for the petitioner submits that the petitioner who is present in court in person would like to settle with the respondents if one year time is granted to the petitioner to vacate the tenanted premises. Let the petitioner place on record an affidavit within two weeks from today undertaking to vacate the tenanted premises and hand over vacant physical possession of the same to the respondent on or before one year from today. He will also in the affidavit undertake to pay the agreed rent of Rs.1,285/- per month and water and electricity charges payable for the period that he occupies the said tenanted premises. He will also undertake not to part with possession of the premises or cause any wilful damage to the premises.

In view of the above, learned counsel appearing for the petitioner submits that he does not wish to press the present Revision Petition. Learned counsel for the respondent submits that if the undertaking by means of affidavit is filed within the period granted by this court the respondent shall not execute the Eviction Order till 1.2.2018.
