% 02.02.2016 Petitioner Noor Alam is not pressing the petition on merits. Counsel for the petitioner under specific instructions from his client (present in person) states that he be granted time upto 30.09.2016 to vacate the suit shop i.e. shop in the property bearing no. 23, old Kardam Puri, Loni Road, Shahdara, Delhi-94.
The prayer is not opposed.
In this intervening period the petitioner will continue to pay admitted rate of rent. Arrears, if any which will be calculated till date shall be paid within four weeks from today. Vacant and physical possession of the suit property will be handed over to the Landlord on or before 30.09.2016 after clearance of all electricity and water charges. Affidavit of compliance by way of undertaking shall be filed by the petitioner in the Court incorporating all the above said averments within two weeks with an advance copy to the respondent.
Petition disposed of accordingly.
