$~1 * IN THE HIGH COURT OF DELHI AT NEW DELHI + W.P.(C) 6948/2017 MANJU ..... Petitioner Through Mr.N.S.Dalal and Mr.Aman Mudgal and Ms.Toral Banerjee, Advocates versus LAND & BUILDING DEPARTMENT ..... Respondent Through Mr.Yeeshu jain and Ms.Jyoti Tyagi, Advocates.
CORAM:
HON'BLE MS. JUSTICE INDERMEET KAUR
O R D E R
% 06.09.2017 Petitioner is aggrieved by the letter dated 01.12.2017 vide which his application seeking allotment of alternate plot has been rejected. It was rejected for the reason that in spite of opportunities having been granted to the petitioner to file his documents he had not filed his documents. Admittedly this order was not passed on merits. Learned counsel for petitioner points out that all efforts had been made to procure the documents and in fact an application seeking certified copies of the said documents is pending before the Department. The Department has to provide these documents which then had to be furnished to the Department; these documents shall be filed before the Competent Authority/respondent within a period of two months. Noting this undertaking on behalf of the petitioner, the order dated 01.12.2017 is set aside. On the petitioner filing the
documents positively within two months from today the case of the petitioner shall be considered on merits as per seniority. Petition disposed of in the above terms.
