The petitioner has filed the present petition under Section 14 and 15 of the Arbitration and Conciliation Act, 1996 (hereafter 'the Act'), inter alia, praying that the mandate of Shri Rakesh Kumar Lakra to act as a sole arbitrator be terminated and an independent arbitrator be appointed in his place. The learned counsel appearing for the respondent states that the allegations made in the petition are unfounded. However, without going into this controversy, the respondent has no objection if an arbitrator is appointed. Accordingly, with the consent of the parties, the mandate of Shri Rakesh Kumar Lakra is terminated.

It is further directed that an arbitrator be appointed by the Delhi International Arbitration Centre (DIAC). The arbitration shall be conducted under the aegis of DIAC and in accordance with its Rules. The parties shall appear before the Coordinator, DIAC on 01.06.2018 at 11:00 AM.

The aforesaid order has been passed with the consent of the parties and without examining the merits of the averments made in the petition. 4.
