% 24.01.2019 By this petition the petitioners seek quashing of FIR No. 219/2017 under Sections 363 IPC registered at PS Uttam Nagar on the complaint of respondent No.2 father of the victim child on the ground that parties have settled the matter.

Learned Additional Standing Counsel for the State submits that the quashing of the FIR on the basis of settlement is seriously objected for the reason the petitioners' abducted a 7 year old child which was found out in the CCTV footage and when notice was given to the auto-rickshaw driver on the next day the child was brought to Uttam Nagar Metro Station. He states that after the present case was registered, petitioners have purportedly unauthorizedly fled the country and are likely to be deported back. W.P.(CRL) 2985/2018

Learned counsel for the petitioner states that petitioner No.1 to 3 are not traceable and thus he seeks discharge.

In view of the fact that the petitioners No.1 to 3 are allegedly absconding from the country and the nature of allegations as stated by learned Additional Standing Counsel for the State, this Court finds no ground to quash the FIR in question on the basis of compromise. Petition is dismissed.
