O R D E R

Both the learned counsel for the parties have stated at bar that the matter has been settled on a total sum of Rs.11 lacs which has to be paid as under :- (a) That an amount of Rs.1 lac has been received by the respondent, Rajesh Aggarwal, who is present in court and is identified by his counsel today itself.

(b) That an amount of Rs.6 lacs has been received by the respondent by way of a cheque issued by the appellant bearing No.210730 drawn on State Bank of India dated 30.4.2016. (c) So far as the balance amount of Rs.4 lacs is concerned, the said amount is stated to have been deposited by the appellant with the Registrar General of this court which has been kept in a fixed deposit. 2.

The learned counsel for the appellant has stated that he has no objection in case the aforesaid amount of Rs.4 lacs be released to the respondent and the interest thereon shall be paid back to the appellant. 3.

Accordingly, the Registrar General is directed to pay a sum of Rs.4 lacs to the respondent.

So far as the interest which has accrued on the aforesaid amount is concerned,

that shall be refunded to the appellant. The learned counsel for the appellant has assured that the cheque which has been issued to the respondent shall be honoured on presentation on the date appearing on the face of the cheque in due course.

In view of the aforesaid submissions made at the bar, the matter is treated as disposed of in terms of the aforesaid settlement. 5.

List for compliance on 4th May, 2016.
