% 25.10.2017 Respondent no. 2 Ms. Sunita is present in Court and has been identified by SI Ashok Kumar of Police Station Patel Nagar. Respondent no.2 submits that she got married to petitioner no.1 on 11th May, 2013 as per Hindu rites and rituals. However, the petitioner no.1 and respondent no.2 started living separately since 17th July, 2015. FIR 975/2015 under Sections 406/498-A/34 IPC was registered on her complaint at PS Patel Nagar on 3rd August, 2015. Respondent no.2 submits that she has settled the matter with the petitioner no. 1 before the Mediation Centre, Tis Hazari Courts, Delhi on 23rd January, 2016 of her own free will and without any undue force, pressure or coercion; therefore, the aforenoted FIR may be quashed. She further submits that her marriage with the petitioner no.1 has already been dissolved by a decree of divorce by mutual consent passed by the Family
Court, West District, Tis Hazari Courts, New Delhi on 19th July, 2017. She admits having received the entire settled amount. Respondent no. 2 further submits that she is not willing to pursue the FIR any further against the petitioner no.1 and his father i.e. petitioner no. 2 and the same may be quashed.
Keeping in view the facts and circumstances of the case as detailed above more particularly, the fact that marriage between the petitioner no.1 and respondent no.2 has already been dissolved, in the interest of justice, FIR 975/2015 under Sections 406/498-A/34 IPC was registered on her complaint at PS Patel Nagar and the consequent proceedings emanating thereform are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
