% 04.12.2017 The learned counsel for the respondent submits that as the concerned officer of the respondent No. 1 is travelling out of country, the affidavit disclosing movable and immovable property of respondent No. 1 could not be filed and he prays for two weeks time to file the same. In Arbitration Petition No. 495/2017, I have today appointed a Sole Arbitrator for adjudication of the disputes between the parties. In view of such appointment, I direct that the respondent shall file the affidavit before the Sole Arbitrator before the first date of hearing. I further direct that the present application shall be treated as an application under Section 17 of the Arbitration and Conciliation Act, 1996 before the Sole Arbitrator, who shall pass appropriate order thereon after hearing both the parties and in accordance with law.
