O R D E R

After arguments this appeal is disposed of by a consent order and in the presence of the parties, that respondent/plaintiff will take a sum of Rs.13 lacs in full and final settlement of the impugned judgment and decree. This amount of Rs.13 lacs will be paid within a period of one year from today with half the amount being paid within a period of six months from today and the balance half will be payable within a period of one year from today. It is however clarified that if the amount of Rs.13 lacs is not paid by the appellant/defendant to the respondent/plaintiff in one year then the impugned judgment as it is will stand revived and the appeal will stand dismissed.

Amount of Rs. 5 lacs deposited in this Court alongwith accrued interest be released to the respondent/plaintiff in partial satisfaction
and payment of the amount which has to be paid by the appellant to the respondent within a first period of six months. 3.
Appeal is accordingly disposed of with the aforesaid consent order.
