versus NATIONAL COUNCIL FOR TEACHER EDUCATION & ANR ..... Respondents Through Mr.Kishan Nautiyal, Adv.

CORAM:

HON'BLE MS. JUSTICE REKHA PALLI

O R D E R

% 20.03.2018 After some arguments, learned counsel for the petitioner submits that though pursuant to the order dated 18th May, 2015 passed by this Court in W.P.(C) 4848/2015, the petitioner was granted liberty to submit a fresh application for the academic year 2016-17, however, instead of submitting a hard copy of the fresh application for the academic year 2016-17, the petitioner re-submitted its earlier application for the previous academic year. He, however, submits that since this Court has vide its order dated 18th May, 2015, granted the petitioner liberty to apply afresh for the academic year 2016-17, the petitioner has also submitted an application in accordance with the said liberty but the respondents have failed to take any action on the said application till date.

Learned counsel for the respondents submits that the

petitioner‟s subsequent application was not considered since the petitioner had failed to supply a hard copy of the same and had in fact tried to hoodwink the respondents by deliberately re-submitting the hard copy of its previous application.

Be that as it may, in view of the specific directions of this Court that the petitioner‟s fresh application would be considered on its own merit, without commenting on the validity of the impugned order whereby the petitioner‟s earlier application stands rejected, the petitioner is granted liberty to submit a fresh hard copy of its application dated 9th July, 2017 to the respondent within two weeks subject to the petitioner fulfilling all other eligibility criteria. The respondents shall within eight weeks process the said application for the next academic year in accordance with its Regulations, by passing a reasoned and speaking order.

The writ petition and application are disposed of in the aforesaid terms.
