O R D E R

% 07.09.2017 We have examined the office orders dated 31st March, 2017 and 3rd April, 2017 and find that the grievance of the petitioner stands addressed.

The petitioner had joined in CRPF as a Constable on 15th January, 1984.

The petitioner was promoted to the rank of Head Constable on 11th December, 2000.

The petitioner had earlier completed 12 years of service on 14th January, 1996 and was eligible for grant of first financial up gradation under the Assured Career Progression Scheme, with effect from 9th August, 1998. Order dated 3rd April, 2017 grants first financial up gradation to the petitioner under the Assured Career Progression Scheme with effect from 9th August, 1998. The said grant is in accordance with law.

The office order dated 3rd April, 2017 also grants second financial up-gradation under the Assured Career Progression Scheme in PB 9300-34800/- with grade pay of Rs.4200/- with effect from. 14th January, 2008. This grant would be in accordance with the scheme as the petitioner had completed 24 years of service on 14th January, 2008 when the Assured Career Progression Scheme was in operation. The Modified Assured Career Progression Scheme would not apply as the same was notified on 19th May, 2009 with retrospective effect from 1st September, 2008.

Learned counsel for the petitioner submits that payment in terms of the said orders including revised pension payment order have not been issued. The respondents would ensure that arrears as payable including the revised pay pension order are issued within a period of four months from the date a copy of this order is received by them.

Writ petition is disposed of on the aforesaid terms. Dasti.
