Respondent no.2, who is also present in the court and has been has been identified by the IO SI Vishnu Dutt, PS Jaitpur, accepts notice.
By way of the present petition, petitioner seeks quashing of FIR No.305/2011 u/s 452/354/324/34 IPC registered at PS Jaitpur and proceedings consequent/ emanating therefrom.
Learned counsel for the petitioner submits that the matter has been settled between the petitioner and respondent no.2 in the Mediation Centre, Saket Courts, Delhi on 10th August, 2016 and in view thereof, respondent no.2 is not willing to continue the criminal proceedings and has no objection if the aforementioned FIR is
quashed.
Learned APP for the State submits that one Raju S/o Nanak Ram, who is co-accused, has not been impleaded in the present petition.
On the oral request made by the learned counsel for the petitioner, Raju is impleaded as respondent no.3. Let amended memo of parties be filed during the course of the day. Respondent no.2 submits that she has settled the disputes with the petitioner out of her own free will and without any pressure, undue force and coercion and is not willing to pursue criminal proceedings against the petitioner and the newly impleaded respondent no.3.
In view of the settlement arrived at between the parties, in my view, no fruitful purpose would be served by continuing the criminal proceedings. Accordingly, in the interest of justice FIR No.305/2011 u/s 452/354/324/34 IPC registered at PS Jaitpur and proceedings consequent/ emanating therefrom are quashed.
