% 18.01.2018 After some hearing, the counsel for the petitioner submits that he may be allowed to withdraw the petition and the application filed therewith and instead to come with a fresh petition, should the need survive, after decision is rendered on the pending application for rejection of the plaint in the suit in which the impugned order was passed under Order 7 Rule 11 CPC presently pending, reserving all the contentions urged here to be agitated at that stage. The petition and the application are dismissed as withdrawn with liberty as prayed, granted. Needless to add, the question of limitation for filing the fresh petition would not arise except with reference to the date of decision on the application under Order 7 Rule 11 CPC.
