% 19.09.2016 CMs 27941/2016 (delay in filing) and 27942/2016 (delay in re-filing) Learned counsel for the respondents states that he has no objection if the delay is condoned.
In view of the statement made, the delay is filing and re-filing the appeal is condoned.
The applications stand disposed of.
LPA 434/2016 We have heard the appellant who has appeared in person. We are not inclined to interfere with the impugned orders passed by Ld. Single Judge disposing of the W.P. (C) No.5655/2014 and CM No. 14005/2014. The appellant during the course of hearing has stated that Discom in question, namely, BSES Rajdhani Power Ltd. had belatedly acted upon the complaint made by the appellant and have rectified the hanging and loose wires.
The BSES Rajdhani Power Ltd. had taken the stand that the internal wiring after the meter have to be repaired and rectified by the consumer and not by the Discom. It is apparent that there were inter se disputes between the appellant and the third parties in respect of property bearing number A70, Ground Floor, NDSF Part-II, New Delhi. In spite of the said position, BSES Rajdhani Power Ltd. has acted on the request of the appellant. The grievance now raised is that BSES Rajdhani Power Ltd. had not taken immediate or prompt remedial action. Functioning of Public Grievance Cell is questioned.
It has not been shown and established that the loose and hanging wires were belonging to or were maintained by BSES Rajdhani Power Ltd. In any case, the problem has been rectified. No further orders are required to be passed.
