% 03.10.2018 Issue notice. Mr. Mehra accepts notice on behalf of the State. He has tendered in court a status report, which is taken on record. The petitioner has preferred the present petition for production of P, daughter of respondent no.4. The petitioner claims that he got married with P on 12.04.2017.

As per the status report, P is a minor since her date of birth recorded in the school records, which has been got verified, is 15.07.2001. On the complaint of the father of P, FIR 127/2017 was registered under Section 363 IPC at PS Kapshera, New Delhi against the petitioner.

The statement of P has also been got recorded under Section 164 Cr PC. Subsequently, section 376 IPC has been added to the case. We have interacted with P in chamber alone as well as with her mother in chamber.

Even without getting into the issue whether she is a major or minor, we may observe that she has stated in chamber that she wishes to reside with her parents and wishes to continue her studies. Presently, she is studying in 11th Grade. She states that she wishes to continue to reside with her parents and does not wish to join the company of the petitioner. In view of the aforesaid, no further orders are called for in this petition. The same is, accordingly, dismissed. VIPIN SANGHI, J I.S.MEHTA, J OCTOBER 03, 2018 sr
