% 05.04.2019 Trial court vide impugned order of 14th September, 2016 directs issuance of process under Section 83 of Cr.P.C. against petitioner. Status report has been filed. As per amended memo of parties of 12th December, 2017 Respondent No. 2-Dinesh Kundra present in the Court is complainant/first-informant of FIR in question and he has been identified to be so, by SI Jay Kishan on the basis of identity proof produced by him. Respondent No. 2 submits that the subject matter of this petition has been mutually resolved between the parties. Upon hearing and on perusal of status report and in view of the stand taken by respondent No. 2/complainant of this FIR, the proceedings under Sections 82 & 83 of Cr.P.C. and the proceedings arising out of FIR under Section 174A of IPC are brought to an end. CRL.M.C. 3437/2017
Consequentially, impugned order of 14th September, 2016 is hereby quashed.
The petition is accordingly disposed of.
