% 23.12.2016 Learned counsel for the petitioner states that petitioner's request for registration of bus has not been decided till date and respondents are demanding parking charges and penalty for delay in getting fitness and permit. He states that the demand raised by the respondents is unjustified as the bus was illegally impounded and retained by them. He further states that despite sending a legal notice dated 29th November, 2016 with regard to the aforesaid, no reply has been received till date.
Issue notice.
Mr.Sanjay Dewan, Advocate accepts notice on behalf of the respondents. He assures and undertakes to this Court that legal notice dated 29th November, 2016 shall be replied to within a period of two
weeks. He also states that the tax and penalty amount, if any, shall be intimated to the petitioner within the said period. The petitioner is given liberty to approach the Commissioner, Transport for waiver of the tax and penalty charges, if any, levied by the respondents, in accordance with the rules. Upon the said application being filed by the petitioner, the Commissioner, Transport is directed to decide the same within a further period of four weeks. With the aforesaid directions, present writ petition and the application stand disposed of.
