% 27.04.2017 This is an application filed under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.463/2016, under Sections 376/313 IPC, registered at Police Station-Kotla Mubarakpur, Delhi. Counsel for the petitioner has submitted that the petitioner is apprehending his arrest from Police Station- Kotla Mubarakpur, Delhi in case FIR No. 463/2016, under Sections 376/313 IPC. He has further submitted that the complainant is a major. He submits that the complainant and the petitioner are cousin and they were in live-in-relationship. He has submitted that the petitioner has already joined investigation and is further ready to join the investigation as and when required. Learned APP for the State vehemently opposes the anticipatory bail application and submits that the allegations against the petitioner are serious in nature. He further submits that the present application is devoid of merits

and the same be dismissed. Learned APP concedes that the petitioner has joined investigation of the case.

As per the FIR, the petitioner and the complainant were adamant to take permission from their family for their marriage; which indicates that there is consent on the part of the complainant. In these circumstances, the petitioner is directed to join further investigation and in the event of his arrest he be released on anticipatory bail in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of IO/SHO concerned.
