After arguments, the impugned order of the trial court dated 13.2.2017 rejecting the plaint as time barred is set aside in view of the averments made in para 9 of the plaint which raised disputed questions of fact. The impugned order dated 13.2.2017 in the case titled as Khushbu Vs. Rajesh Kumar Mehlawat passed by the Court of Sh. Virender Bhat, ADJ, Dwarka is set aside with directions to the parties to appear before the District and Sessions Judge, South West, Dwarka Courts, New Delhi on 16th February, 2018 and the District and Sessions Judge will mark the suit for disposal to a competent court in accordance with law. 2.

It is also agreed and recorded that both parties will not take more than

four opportunities each to complete their evidence in chief. 3.

The appeal is accordingly allowed and disposed of in terms of the aforesaid observations.
