% 25.01.2017 Despite notice, respondent No. 4 did not choose to appear. We have heard the learned counsel appearing for the appellant as well as the learned Standing Counsel appearing for North Delhi Municipal Corporation/respondent No. 1. We have also heard the learned ASC for GNCTD (respondent Nos. 2 & 3).

Having regard to the specific allegation in the writ petition that the respondent No. 4 has been proceeding with unauthorised construction and in view of the order dated 27.01.2010 passed by this Court in W.P.(C) No.13742/2009, we direct the respondent Nos. 1 to 3 to ensure that the respondent No. 4 shall not proceed with any construction over the land in

question till the disposal of the main writ petition. W.P.(C) No.11686/2016 be listed before the learned Single Bench on the date already fixed i.e. 01.02.2017.

The appeal is accordingly disposed of.

Copy of the order be given dasti under the signature of the Court Master.
