O R D E R

% 21.08.2017 CM No.29591/2017 Allowed, subject to all just exceptions.

The application stands disposed of.

W.P.(C) 7145/2017 & CM No.29590/2017 The learned counsel for the petitioner seeks to withdraw the present petition with liberty to file afresh.

It is seen that the principal grievance of the petitioner is with regard to the order dated 25.07.2017, whereby the respondents had terminated the contract with the petitioner and also blacklisted it. As far as the relief regarding termination of contract and other interim reliefs are concerned the W.P. (C) 7145/2017

petitioner has already invoked the arbitration clause and, therefore, those reliefs cannot be examined in this petition. However, as far as the question of black listing is concerned, it is seen that the petitioner has sought no prayer in that regard. In the circumstances, the petitioner is permitted to withdraw the present petition with liberty to file afresh restricting its challenge to the issue of blacklisting.

The petition and the pending application are dismissed as withdrawn with the aforesaid liberty.
