% 19.01.2017 Crl. M.A. No. 1051/2017 (exemption) Allowed, subject to all just exceptions. Application is disposed of. W.P.(CRL) No. 173/2017 Petitioner nos. 1 to 4 and respondent no. 2 are related to each other. Petitioner no. 5 is the neighbour of petitioner nos. 1 to 4. It is submitted that petitioners (accused) and respondent no. 2 (complainant) have settled their disputes vide MOU/Settlement Deed dated 3rd June, 2015 coupled with Supplementary Deed dated 14th July, 2015 (Annexure P-2 collectively).

Respondent no. 2, who himself is an Advocate, is present in Court along with his counsel and submits that he has settled the matter with the petitioners of his own free will and without any undue force, coercion and pressure. He further submits that FIR may be quashed. Keeping in mind the fact that settlement has been arrived at between the petitioners and respondent no. 2, no fruitful purpose would be served to keep the criminal proceedings pending.

Accordingly, in the interest of justice, FIR No.840/2014 under Sections 323/341/380/452/453/454/455/506/34 IPC registered at Police Station Model Town, which is at the investigation stage, is quashed. Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J.
