% 24.03.2017 Having heard counsel for the petitioner, we are not inclined to interfere with the impugned order dated 7th June, 2016 passed by the Central Administrative Tribunal dismissing OA No. 3431/2015. The petitioner had challenged the order dated 15th June, 2015 transferring him petitioner from SBG Office, Jaipur, (Rajasthan) to Zonal Office Aizwal (Mizoram).
There are reasons why we are not inclined to entertain the present writ petition. The impugned order is dated 7th June, 2016 and the present writ petition was filed in December, 2016 and on being returned under office objection was re-filed on 7th March, 2017. The petitioner had joined the transfer posting pursuant to the transfer order dated 15th June, 2015 as there was no interim stay. The petitioner was again transferred vide order dated
28th March, 2016 from Aizwal to Gauhati. The factum of this transfer was not brought to the notice of the Tribunal and the OA was not amended. The petitioner has not challenged the transfer order to Gauhati and has joined the said posting.
In view of the aforesaid position, we are not inclined to interfere with the impugned order, without expressing any opinion on merits. The writ petition is dismissed.
