This application is filed on behalf of the Plaintiff under Order XXIII Rule 1 read with Section 151 CPC for withdrawal of the suit. 2.

Issue notice.

Mr. Ankur Sangal, learned counsel accepts notice on behalf of the Defendant.

For the reasons stated in the application, the same is allowed permitting the Plaintiff to withdraw the suit unconditionally. 5.

Application stands disposed of.

Suit is disposed of as withdrawn.

Learned counsel for Defendant submits that pursuant to orders of this Court passed from time to time, a sum of Rs. 82,55,979/- has been deposited CS(COMM) 1674/2016 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. in Court and since the suit is withdrawn, the money be released to the Defendant along with up to date interest. Counsel for Plaintiff has no objection to this request.

Accordingly, it is directed that sum of Rs. 82,55,979/- be released to the Defendant along with interest accrued up to date. For this purpose, the matter be listed before the concerned Joint Registrar on 19.01.2026, who shall release the amount to the Defendant, subject to verification and other formalities.

Date of 27.01.2026 stands cancelled.
