O R D E R

% 09.10.2017 The petitioner seeks anticipatory bail in connection with FIR No.287/2016 dated 15.03.2016 (PS Uttam Nagar) instituted for the offences under sections 448/380 of the IPC.

The allegations against the petitioner is of entering into the premises of the informant and vandalising the same. Learned counsel for the petitioner has submitted that actually the property was purchased by him long time ago by virtue of a sale deed which is unnecessarily disputed by the informant who claims to be a purchaser on a later date.

By order dated 18.04.2017, interim protection was granted to the petitioner but it was directed that he ought to participate in the investigation.

Ms.Neelam Sharma, APP, on instructions, informs this Court

that the petitioner has been participating in the investigation. Considering the aforesaid facts, this Court is inclined to confirm the interim protection granted to the petitioner by this Court. In the event of arrest or surrender, the petitioner shall be released on bail on his furnishing a bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the arresting officer/Court.

The petitioner shall, however, continue to participate in the investigation. He shall not make any efforts to evade the process of law. Should he do so, it would be open for the state to proceed for cancellation of the anticipatory bail given to the petitioner. The application is disposed of.
