W.P.(C) 12191/2016 & CM No. 48104/2016 After some arguments, learned counsel for the parties have consented to the passing of the following order:- 1.

The parties shall forthwith enter into negotiations for the purposes of finalizing the terms and conditions of the Model Interconnect Agreement.

In case, on or before 31.12.2016, the negotiations are not successful and parties are not able to agree on the terms and W.P.(C) 12191/2016

condition of the Model Interconnect Agreement, the petitioner shall enter into a Standard Interconnect Agreement. 3.

The Standard Interconnect Agreement would be without prejudice to the negotiations between the parties, which may continue even after signing of the standard Interconnect Agreement. If the parties reach a settlement on the terms and conditions of the Model Interconnect Agreement, the parties would be at liberty to enter into the same, which would then supersede the Standard Interconnect agreement between the parties.

Till the terms of the Model Interconnect Agreement are finalised, or if the negotiations fail, the petitioner would be bound by the Standard Interconnect Agreement. 5.

In so far as the claim of past dues of the respondent are concerned, the parties agree that the same would be subject to further orders of the TDSAT. The same would not preclude the parties from entering into the Model or the Standard Interconnect Agreement, as the case may be.

The writ petition is accordingly disposed of in terms of the above agreement between the parties.
