Present Writ petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C. has been preferred by the petitioner to seek parole. Status report is on record. 2.

I have heard the learned counsel for the parties and have examined the file.

The petitioner was convicted under Section 376(2)(g)/328 IPC in case FIR No.136/2008 registered at Police Station Tilak Nagar and was sentenced to undergo imprisonment for life. Criminal Appeal No.447/2013 was dismissed by this court vide order dated 28.05.2015.

The petitioner seeks parole to attend the marriage of his real brother namely Hemant Porwal fixed for 16.01.2017. Factum of W.P.(CRL) 3/2017

marriage of petitioner's real brother has been verified and confirmed. It further reveals that earlier also the petitioner was granted interim bail, parole and furlough. There are no allegations of its misuse. The petitioner has already undergone more than eight years incarceration. 4.

Status report reveals that the address of the petitioner has since been verified and confirmed.

In the interest of justice and to enable the petitioner to participate in the marriage of his real brother, he is granted parole for five days from the date of his release, subject to his furnishing a personal bond in the sum of `30,000/- with one surety in the like amount to the satisfaction of the Trial Court/CMM/Duty Magistrate. After completion of parole period the petitioner shall surrender before the Jail Superintendent.

Writ petition is disposed of in the above terms. 7.

Copy of the order be sent to the Superintendent Jail for serving it on the petitioner and also for compliance. S.P.GARG, J.
