This is an application moved on behalf of the petitioner under Section 439 CrPC seeking interim bail in case FIR No.276/2017 under Section 307/34 IPC and under Section 27/30 Arms Act, PS Seelampur, Delhi. 2.

The petitioner is seeking interim bail on the ground that his minor son namely Master Hasnain aged about 5 years is suffering from hip adduction deformity/disability since birth and he has to undergo surgery on 11th August, 2017 at St.Stephen's Hospital.

Status report has been filed by the State mentioning therein that son the petitioner namely Hasnain was admitted in St.Stephen's Hospital on 9th August, 2017 and the surgery is to be conducted on 11th August, 2017. Alongwith the status report, certificate issued by the hospital to the above effect has also been annexed.

Taking into consideration the ground on which the petitioner is seeking interim bail i.e. for taking care of his son who has to undergo surgery on 11th August, 2017, the petitioner is granted interim bail for a period of one week from the date of his release on his furnishing personal bond in the sum of ₹30,000/- with one surety in the like amount to the satisfaction of learned MM/Link MM/Duty MM subject to the following conditions:- (i) The petitioner shall not try to contact the witnesses or tamper with the evidence.

(ii) The petitioner shall not leave the country without permission of the Court.

(iii) The petitioner shall furnish his mobile number to the SHO/IO concerned and keep the same active throughout the period of interim bail. 5.

The petitioner is directed to surrender before the concerned Jail Superintendent after expiry of period of interim bail. 6.

The application is disposed of.

As prayed, copy of the order be given dasti to learned counsel for the petitioner under the signature of Court Master and be also sent to the concerned Jail Superintendent for information. PRATIBHA RANI, J.
