Learned counsel for the respondent says that contrary to what was conveyed to this Court, which is, that action on the petitioner‟s complaint was taken only qua the statutory auditor and not the internal auditor was not correct.

Learned counsel says that the respondent says that the Disciplinery Directorate has formed a prima facie view both against the statutory auditor as well as the internal auditor and that presently the complaint is pending before the Disciplinary Committee for enquiry.

To be noted, this aspect of the matter has also been adverted to in the counter affidavit filed on behalf of the respondent. A copy of the order passed by the respondent in this behalf has been furnished to the counsel for the petitioner.

I am further informed by the counsel for the respondent that the counter affidavit was filed with the registry on 29.1.2018 via
Diary No. 28090. The registry will place the same on record. 5.
Counsel for the petitioner says that having regard to the averments made in the counter affidavit filed by the respondent, the petitioner‟s grievance for the present stand addressed. Furthermore, learned counsel says that he has instructions, in these circumstances, not to press further.

The said statement is taken on record. The petition is, accordingly, disposed of.
