O R D E R

% 02.03.2017 Further status report has been tendered in Court and taken on record. The petitioner has also filed his additional affidavit. The petitioner claims that the painting work is in progress in the property. Even as per the status report, the construction work is almost complete and finishing work is going on.

The petitioner has preferred this petition to seek parole on the ground that he has to attend to the ongoing work at his premises. The petitioner is convicted in case FIR No.57/2008 under Sections 302/ 498A IPC registered at PS - Anand Parbat. He is undergoing a life sentence. The petitioner has already undergone nearly 8 years and 9 months of incarceration as on date. His jail conduct is satisfactory. His overall jail conduct is stated to be

unsatisfactory on account of his being subjected to a punishment on 04.09.2012. However, even thereafter he has been released on furlough and parole. Therefore, the said punishment is of no avail. The petitioner was lastly released on parole on 14.10.2015 for a period of one month. Considering the fact that the petitioner has to attend to the ongoing construction/ finishing work, the petition is allowed. The petitioner is directed to be released on parole for a period of four weeks subject to: vi) his furnishing personal bond with one surety in the sum of Rs.10,000/- to the satisfaction of the Jail Superintendent; vii) he shall provide his mobile phone number to the Jail Superintendent at the time of his release, which shall be kept in working condition at all times. The same shall not be changed without prior intimation to the Jail Superintendent;

viii) he shall report at the local police station to mark his attendance on every Monday at 11:00 a.m. during the period of parole; ix) he shall duly surrender at the end of the period of parole; and x) he shall also not indulge in any criminal activity while on parole.
