O R D E R

% 13.12.2017 By this petition the petitioner seeks parole to re-establish social ties and to arrange funds for the family. On a notice being issued to State, a Status Report has been filed. As per the Status Report the petitioner is unmarried and both his parents have passed away. The sister of the petitioner is residing in her matrimonial home whereas the elder brother is residing at Village/Post Fatehpur, PS Didarganj, Distt. Patna, Bihar. The parole of the petitioner is opposed on the ground of unsatisfactory conduct of the petitioner in jail.

A perusal of the record reveals that the conduct of the petitioner has been unsatisfactory however, after the petitioner was granted a parole for a W.P.(CRL) 2339/2017

period of three weeks by this Court on 28th July, 2016, there was no misconduct by the petitioner and the petitioner surrendered on the expiry of the parole.

Considering the facts noted in the Nominal Roll, the fact that the petitioner has not been granted parole for more than a year and that he did not misuse the earlier parole granted, this Court deems it fit to grant parole to the petitioner.

It is, therefore, directed that the petitioner be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, who would be a family member of the petitioner, subject to the satisfaction of the learned Trial Court/CMM.

Petition is disposed of.

A copy of this order be communicated to the petitioner through Superintendent, Mandoli Jail.
