O R D E R

% 04.05.2017 This is a petition under Section 482 Cr.P.C. for quashing of FIR No.254/2009, under Sections 448/454/380/420/467/468/471/506/120-B/34 IPC, registered at Police Station Amar Colony, New Delhi and all the proceedings emanating therefrom.

Learned counsel for the petitioners submits that the petitioners are innocent persons and due to a misunderstanding arisen between the parties, the respondent No.2/complainant got registered the aforesaid FIR against the petitioners at Police Station Amar Colony, New Delhi. Counsel further submits that after the registration of the FIR when the investigation in the FIR started, the petitioners came to know about the name of the complainant

and thereafter the petitioners and the respondent No.2/complainant sat together and settled their dispute amicably voluntarily and without any force, pressure or coercion. Counsel further submits that the said settlement has been reduced into writing before the Mediation Centre, Saket Courts, New Delhi vide settlement deed dated 29.06.2015. Counsel further submits that the entire dispute pertaining to the aforesaid incident has been settled and nothing further remains to be adjudicated between the parties and submits that the FIR in question is coming as hurdle in the peaceful life of the present petitioners and prays that the FIR in question and all proceedings arising therefrom may be quashed.

The respondent No.2/complainant, Mr.Vijay Kumar Garg is present in Court today and has been identified by the Investigating Officer, SI Ashok, PS Amar Colony, New Delhi. The respondent No.2/complainant present in person admits that the dispute pertaining to the aforesaid incident has been amicably settled with the petitioners and he has received all due amounts from the petitioners and nothing remains to be adjudicated further between them and he has no objection if the FIR in question is quashed. Looking into the above facts and circumstances of the case since the dispute pertaining to the aforesaid incident has been sorted out amicably between the parties and the same has been reduced into writing before the Mediation Centre, Saket Courts, New Delhi vide settlement deed dated 29.06.

2015 and nothing further remains to be adjudicated between the parties, to have better relations between the parties in present and in future, I deem it appropriate to quash the FIR and all its subsequent proceedings. Consequently, FIR No.

Station Amar Colony, New Delhi and all the proceedings emanating therefrom are hereby quashed.

The present petition is allowed and disposed of accordingly. Copy of this order be given dasti.
