O R D E R

% 04.12.2017 This petition under Section 11 of the Arbitration and Conciliation Act, 1996 has been filed by the petitioner seeking appointment of an Arbitrator /Arbitral Tribunal consisting of three Arbitrators for adjudication of the disputes that have arisen between the parties in relation to the agreement dated 28th June, 2012 for construction of ROBs.

The respondent in its reply has annexed a list of retired officers empanelled as Arbitrators duly approved by the CMD of the respondent.

Without prejudice to the rights of the petitioner, the petitioner prays that Mr.Pradeep Kumar Gupta, Special Director General/CPWD be appointed as petitioner's nominee Arbitrator. Counsel for the respondent submit that Dr. Prem Singh Rana, CMDHUDCO has been nominated as an Arbitrator on behalf of the respondent. Both parties pray that a retired Judge of this Court be

appointed as the presiding Arbitrator. Accordingly, I appoint Justice R.C.Chopra, retired Judge of Delhi High Court, N-7, Greater Kailash-I, New Delhi-110048, Mobile-9818097777 as the presiding Arbitrator for adjudication of the disputes. The three Arbitrators will duly file their declarations in terms of Section 12 before proceeding with the arbitration proceedings.
