O R D E R

The petitioner has filed the present petition, inter alia, praying as under:- "(a) That the Hon'ble Court be pleased to issue an appropriate writ, order or direction to Respondents to consider the representation dated 06.08.2017 of the Petitioner and provide him with Police Security/assistance in evacuating the illegal encroachers peacefully from the plot.

(b) That the Hon'ble Court be pleased to issue an appropriate writ, order or direction to Respondents to consider the representation dated 06.08.2017 of the Petitioner and provide him with Police Security/assistance to erect the boundary wall on the plot. "

Learned counsel appearing for the respondents states that they have W.P. (C) 6952/2017

not restrained any construction on the said property, however, they are not in a position to state whether there is any requirement for rendering any police assistance.

It is difficult to accept that the respondents have any obligation to render any assistance to the petitioner. The petitioner is free to construct the boundary wall and take such steps in respect of the land in question subject to the petitioner having any right over the same and subject to the petitioner being in possession of the same. The respondents have a duty to maintain law and order and needless to state that the respondents shall take such steps as necessary for ensuring the same.

The petition is disposed of with the aforesaid observations. 5.

Order dasti to both the parties.
