O R D E R
% 17.08.2017 This is a petition under Section 482 Cr.P.C. for quashing of FIR No.0034/2012, under Sections 328/380 IPC, registered at Police Station North Rohini, Delhi and all proceedings emanating therefrom. Learned counsel for the petitioners has submitted that the petitioners were the tenants of the father-in-law of the respondent No.2 herein and during the subsistence of the tenancy, a misunderstanding has arisen between the parties, which resulted into the registration of the aforesaid FIR against the petitioners. Counsel further submits that after the registration of the FIR, the near relatives and the friends intervened and the
misunderstanding has been sorted out and the dispute has been amicably settled/resolved between the parties and the same has been reduced into writing on 4th August, 2017 and further submits that nothing further remains to be adjudicated between the parties, however, the present FIR is coming as hurdle in the peaceful life of the petitioners and prays that the FIR and all subsequent proceedings arising of the same may be quashed. The respondent No.2/complainant Smt. Nidhi Bansal is present in Court today and has been identified by the Investigating Officer ASI Karamvir of Police Station North Rohini, Delhi and also represented by her counsel. The respondent No.2 present in person admits the factum of amicable settlement with the petitioners and execution of settlement agreement on 4th August, 2017.
She further admits that the petitioners were the tenants of her father-in-law and further submits that the said settlement reached with the petitioners is voluntary and without any force, pressure or coercion and further submits that she has no objection if the FIR is quashed. Looking into the above facts and circumstances, since the misunderstanding has been sorted out and the matter in dispute has been amicably settled between the parties and the same has been reduced into writing on 4th August, 2017 and nothing further remains to be adjudicated between the parties, to have peace in the life of both the parties and to have better relations between them in present and in future and to meet the ends of justice, I deem it appropriate to quash the present FIR and all proceedings arising therefrom.
Consequently, FIR No.0034/2012, under Sections 328/380 IPC, registered at Police Station North Rohini, Delhi and all proceedings emanating therefrom are hereby quashed. Parties shall remain bound by the
terms of settlement dated 4th August, 2017.
The present petition is allowed and disposed of accordingly. Copy of the order be given dasti to the parties, as prayed. I.S.MEHTA, J AUGUST 17, 2017 'dc'
