1. The assertions of the LAC in para 8 of the reply that compensation paid to the Petitioner, indicating the cheque numbers and dates of the cheques have not been denied by the Petitioner. Time was sought for filing rejoinder but that has not been filed.
2. The counsel for the Petitioner disputed the assertion by the Respondents that physical possession of the land in question has been taken over. However, learned counsel for the Respondents points out that there was no question of paying compensation without taking over physical possession.
3. In the circumstances, the Court accepts the averments stated in the counter-affidavit and dismisses the petition. S. MURALIDHAR, J.
