% 06.01.2017 Petitioner and respondent no.2 have settled their disputes before the Delhi High Court Mediation and Conciliation Centre on 5th December, 2016. Respondent no.2 is present in Court and submits that he was handed over four cheques for total settled amount of `6 Lakhs. The cheque dated 20th December, 2016 of `3 Lakhs has already been encashed. Remaining cheques are dated 20th April, 2017, 20th June, 2017 and 20th August, 2017 for `1 Lakh each and details thereof have been mentioned in para 7 (b) of the Settlement Agreement. He submits that he has no objection in case FIR is quashed subject to encashment of these three cheques. Keeping in mind the settlement arrived at between petitioner and

respondent no.2 before the mediation centre, FIR No.596/2016 under Sections 420/406/506/120B IPC registered at police station Rajouri Garden as well as complaint case being CC No.39/1/16 (New No.14399/2016) pending before Learned Metropolitan Magistrate (West-02), Tis Hazari Courts, Delhi are quashed, subject to however encashment of aforesaid three post dated cheques.

In case the cheques are dishonoured, FIR shall get revived.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
