% 10.08.2018 IA No.10683/2018 This application is for ex-parte stay for proceedings before the arbitral tribunal. It is submitted by learned counsel for the applicant that they had given name of one Justice Dilip Raosaheb Deshmukh (Retd.) as the nominee arbitrator but the court appointed Justice Aruna Suresh (Retd.) as the arbitrator for which the consent was not given by learned counsel for the plaintiff. The record shows that the proceedings have already been initiated by the arbitral tribunal but since the order of appointment is sought to be modified and an application qua the said request is still pending, hence it would be appropriate if the proceedings before the learned arbitral tribunal be stayed till the next date of hearing. Issue notice to the non-applicants through counsel by all modes returnable on 13th September, 2018, the

date already fixed.
