% 17.08.2017 Status report has been filed and taken on record. Learned counsel for the petitioner submits that petitioner is a jeweller. Allegations against him are that he was found in possession of the looted jewellery. As per the FIR, four persons between 25 to 30 years of age had entered and committed robbery. Initially, FIR No. 229/2017 was registered under Sections 392/34 IPC at Police Station Malviya Nagar. Petitioner is aged about 58 years and cannot be said to be involved in the robbery. Petitioner is in custody for the last 47 days. Petitioner may be enlarged on bail.

Learned APP submits that offence of dacoity under Section 395 IPC

was added subsequently. As per the CCTV footage, five persons were seen at the spot, thereafter part of the looted jewellery was recovered from the petitioner, therefore, offence under Section 412 IPC has been added subsequently.

Keeping in mind the totality of facts and circumstances as narrated above, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `50,000/- (Rupees Fifty Thousand Only) with one surety in the like amount to the satisfaction of the trial court. Bail application is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti. A.K. PATHAK, J.
