This petition is filed under Section 11 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as 'the Act') seeking appointment of an arbitrator in terms of clause 21 of the MOU dated 04.09.2015 to adjudicate the disputes between the parties. 2.

The present controversy arises out of MOU dated 04.09.2015 executed between the parties.

Dispute having arisen between the parties, the petitioner has invoked the arbitration clause on 23.02.2017.

The learned counsel who has entered appearance on behalf of respondents submits that his clients have no objection in case a sole arbitrator is appointed by the court without prejudice to the rights and contentions of the respondents.

Accordingly, Mr.G.C.Gupta (Mobile No.9999440774) Retd. Vice President ITAT,6/3, Lower Ground Floor, Jungpura B, New Delhi-110014 is

appointed as the sole arbitrator to adjudicate the dispute between the parties. The arbitration shall take place under the aegis of Delhi International Arbitration Centre, New Delhi (in short 'The DIAC'). A copy of this order be sent to the DIAC and to the learned arbitrator. 6.

The petition stands disposed of as above.
