% 23.08.2017 The petitioner is aggrieved by the inaction on the part of the respondent; his submission his that he has strong apprehension that a bill will be raised by the respondent which would be against the terms of the license deed dated 22.04.1982; submission is that this threat had actually been reduced into writing in terms of a communication dated 28.02.2017.
This Court notes that the petitioner had approached this Court in W.P.(C) No.5845/2017. Similar contentions have been raised. This petition had been disposed of on 14.07.2017 on the statement made by the learned senior counsel for the respondent informing this
Court that the provisional bill which has been raised qua the petitioner shall be withdrawn and an appropriate bill shall be issued. This order was passed on 14.07.2017. Learned senior counsel for the petitioner points out that even after 14.07.2017, no action has been taken by the respondent and the said appropriate bill has not been issued by the respondent. Learned senior counsel for the petitioner additionally points out that a direction was given as way back as on 18.01.2017 (in W.P.(C) No.484/2017) that the respondent would raise the final bill on the petitioner so that they know exactly where they stand. It is reiterated by the learned senior counsel for the petitioner that till date that final/appropriate bill has not seen the light of the day. The respondent will issue the appropriate/final bill within four weeks from today. No further orders are called for in this petition. Petition is disposed with additional liberty granted to the petitioner to raise all other contentions in appropriate proceedings which he may take up subsequently.
