% 01.09.2017 C.M. Nos.31817-18/2017 Exemption allowed, subject to all just exceptions. The application stands disposed of.

W.P.(C) 7688/2017 & C.M. Nos.31816/2017 The petitioner assails the order dated 31.08.2016 passed by the Central Administrative Tribunal, Principal Bench, New Delhi (the Tribunal) in O.A. No.2978/2016 whereby the tribunal directed that the superannuation of the respondent be kept in abeyance till the next date. It appears that thereafter the matter had been listed before the tribunal from time to time.

Firstly, we may observe that the impugned order was passed a little over a year ago. There is no explanation for the delay in assailing the same. Moreover, the said order was passed in view of the interim orders issued in O.A. Nos.2712/2016 and 2946/2016. The aforesaid OAs have been allowed by the tribunal on 24.08.2017 in favour of other employees like the respondent thereby holding that the age of retirement has been raised to 65 years.

In view of the aforesaid position, we are not inclined to interfere with the impugned order. Dismissed.
