O R D E R

% 24.11.2017 This is a petition under Section 11 of the Arbitration & Conciliation Act, 1996 (hereinafter referred to as the 'Act') seeking appointment of an arbitrator for adjudication of the disputes that have arisen between the parties in connection with an agreement dated 13.11.2014 for Fabrication, Erection, Testing and Commissioning work of CS Piping by TIG process at KAPP 3&4 for NPCIL's Primary Piping Package.

Learned counsel for the respondent submits that, without in any manner admitting the contents of the petition, the respondent has no objection if a Sole Arbitrator is appointed for adjudication of the disputes. With the consent of the parties, parties are referred to the Delhi International Arbitration Centre (DIAC) who shall appoint a Sole Arbitrator

to adjudicate the disputes between the parties. The arbitration and the fee shall be governed by the rules of the DIAC.

The parties to appear before DIAC on 5th January, 2018 at 4:00 PM. Date is being fixed at the request of learned counsel for the parties. The petition is allowed in the above terms.
