After arguments, and at the stage of dictation, learned counsel for the appellant states that the appeal be disposed of as not pressed but the appellant be given time up to 31.1.2018 to vacate the suit premises and within 15 days the appellant will clear all arrears of rent/mesne profits and for the further period of stay will pay every month, month by month mesne profits as determined by the trial court. Appellant will also clear all charges towards electricity, water etc for the period the appellant stays in the suit premises.

Let the appellant file an affidavit of undertaking in this Court within one week in terms of the present order and on the appellant filing the undertaking and complying with the terms of the same, the appellant will not

be evicted from the suit premises till 31.1.2018. 3.
