The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.325/2015 registered under Sections 420/120 B IPC at PS Neb Sarai. Status report is on record.

I have heard the learned counsel for the parties including the complainant's counsel and have examined the file. The petitioner is in custody since 29.02.2016. Petitioner's counsel, on instructions, has volunteered to pay `4 lacs to the complainant without prejudice and subject to future adjustment (if any).

Considering the facts and circumstances of the case, the petitioner is admitted to bail on his furnishing personal bond in the BAIL APPLN. 90/2017

sum of ` 40,000/- with one surety in the like amount to the satisfaction of the Trial Court.

`4 lacs shall be paid to the complainant without prejudice on the next date of hearing before the Trial Court i.e. 25th May, 2017. In case of non-compliance, the complainant will be at liberty to approach this Court.

The bail application stands disposed of.
