The matter was heard on 16th January, 2026, when counsel for the appellant was asked to take instructions whether the appellant wishes to pursue the present appeal.

Ms. Kanika Agnihotri, counsel for the appellant on instructions from Mr. Aftab Ahmed, Liaison Officer of the appellant Bank, who is present in Court, submits that the appellant does not wish to pursue the appeal any further.

The money deposited by the appellant pursuant to the impugned judgment and decree has already been released in favour of the respondents subject to the respondents furnishing a bank guarantee. 4.
