% 11.03.2019 IA No. 1274/19 (u/O VIII R 1(as amended by Sec.16 & 4(D) of the Schedule to the Commercial Courts Act, 2015) r/w 151 CPC) Present IA is filed by defendant seeking condonation of delay in filing written statement. It is stated in the IA that there is delay of 112days. Same is not disputed by opposite party. It is submitted that mediation talks were going on between the parties and due to the said reason delay was caused in filing written statement.

Present IA is opposed by plaintiff stating that defendant has miserably failed to disclose any substantial cause or valid reason for delay in filing written statement. It is further stated that defendant has not given any substantial ground for condoning the delay. Ground taken in the application is plausible. Delay in filing written statement is condoned subject to payment of cost of Rs.15,000/-. According the present IA is disposed of.

CS(COMM) 1153/2018 WS is taken on record. Plaintiff is directed to file replication with advance copy to opposite side.

Matter be put up before Hon'ble Court for further directions on date already fixed i.e. 13.3.19.
